1. APPLICATION OF THE GENERAL CONDITIONS OF SALE

These general terms and conditions of sale (hereinafter "GTC") apply, in their version in force at the time of the order, to all orders placed by any person (hereinafter "you" or "the Customer") via the website www.adoré.be (hereinafter "the Site") with the company ORÉ SRL (hereinafter "we" or "the Seller"). You declare that you have read and accepted the GTC as well as the rights and obligations arising therefrom before placing your order. Validation of your order therefore constitutes acceptance without any restriction or reservation of the current GTC.

All our deliveries, services and offers are exclusively governed by these General Terms and Conditions. The Customer therefore waives the right to rely on any contradictory document, in particular its own general and/or specific terms and conditions, even if the latter stipulate that they apply exclusively. Any deviation from these general terms and conditions must, to be valid, have been previously and expressly approved in writing by ORÉ SRL and must be expressly mentioned in the article of these general terms and conditions from which it is derogated.

Failure by a Customer to comply with their obligations under these General Terms and Conditions may result in the suspension or even termination of their account, without prejudice to any damages that ORÉ SRL may claim.

ORÉ SRL reserves the right to adapt or modify these General Terms and Conditions at any time. The version of the General Terms and Conditions applicable to any sale is the one appearing online on the Website www.adorecosmetics.be at the time of the order.

2. INFORMATION ABOUT THE SITE AND ACCESSIBILITY OF THE SITE

www.adorecosmetics.be is an e-commerce site owned and operated by ORÉ SRL

The Site is accessible to all users of the Internet network in principle 24/24h, 7/7d, except for interruption, scheduled or not, by ORÉ SRL or its service providers, for the needs of its maintenance and/or security or in cases of force majeure (as defined below). ORÉ SRL cannot be held responsible for any damage, whatever its nature, resulting from unavailability of the Site.

ORÉ SRL does not guarantee that the Site will be free from anomalies, errors, or bugs, nor that the Site will operate without failure or interruption. In this regard, it may freely and at its sole discretion determine any period of unavailability of the Site or its content. ORÉ SRL cannot be held responsible for data transmission, connection, or network unavailability problems.

ORÉ SRL reserves the right to modify the Site for technical or commercial reasons. When these modifications do not substantially and negatively alter the conditions of service provision, the customer may be informed of the changes, but their acceptance is not requested.

The website www.adorecosmetics.be is hosted by Odoo.

3. CONDITIONS OF REGISTRATION ON THE SITE

3.1. When registering, you agree to provide accurate and complete information. The username and password allowing access to the Site are confidential and must not be disclosed to third parties. After clicking the "REGISTER" button, you will receive confirmation of your registration by email.

3.2. You agree to refrain from any disruption to the Site and from any use, beyond simple online consultation, of the data appearing on this Site. Any illicit manipulation with a view to obtaining undue payments or other advantages to our detriment or that of other customers of the Site will result in the loss of the right to access your customer account.

3.3. When we detect suspicious behavior on our website, for example through anomalies or irregularities in orders, fraudulent transactions, misuse of promotions and violation of the conditions for holding a customer account, we reserve the right to investigate and take measures, including but not limited to blocking (bank) accounts and/or payments, occasionally or permanently, or canceling orders. The measures to be taken and the time at which they should be taken are at our sole discretion.

Furthermore, we reserve the right to add the data subjects to our fraud database, in compliance with applicable data protection laws and regulations. This personal data linked to the fraud database is processed on the basis of our legitimate interests, namely the protection against and prevention of damage to our business by fraudulent actions. The Personal Data contained in the database will be retained for a period of 1 to a maximum of 5 years, depending on the severity of the violation of the Internal Rules.

3.3. Each Customer may only open one customer account. We reserve the right to delete any multiple registrations without notice and to formally notify the customers concerned, to terminate their registration or to delete or modify without notice any data that contravenes the provisions of Articles 3.1, 3.2 and 3.3.

3.4. Registration on our Site is free and you can cancel it at any time. You can delete your customer account by sending an email with your request to contact@adorecosmetics.be 

3.5. By registering on the Site, the Customer declares and guarantees to ORÉ SRL that he/she is of legal age and has the legal capacity to enter into a contract.

ORÉ SRL may delete the Client's account at any time, for any reason, at its sole discretion.

3.6 All elements present on the website www.adorecosmetics.be, whether visual, textual or audio, are the exclusive property of ORÉ SRL, or of the holder of the intellectual property rights concerned and are as such protected by the intellectual property code and copyright. As such, any reproduction of the ADORÉ brand or the website www.adorecosmetics.be, in part or in full, is strictly prohibited.

The company names, trademarks, and distinctive signs appearing on the website www.adorecosmetics.be are protected by Belgian and international law. Any use, reproduction, distribution, or representation of all or part of any of the aforementioned signs without the express written authorization of the relevant owner is prohibited.

You may link to our website, provided you do so in a fair manner and do not damage our reputation or take advantage of our goodwill. However, you must not establish a link in such a way as to suggest any form of association where none exists. Furthermore, it is strictly forbidden to establish a link to our site from any website that is not owned by you. We reserve the right to remove links without notice.

4. DOWNLOADING AND CONSULTATION OF CONTRACTUAL PROVISIONS

4.1. You can consult these General Terms and Conditions at any time on our website www.adorecosmetics.be. You can print or save this document.

4.2. You can also archive the contractual terms of your order by downloading the General Terms and Conditions and saving either the summary of your order in the online shop using your browser or the order confirmation email that is automatically sent to the email address you provided after your purchase. This order confirmation contains your order details and a link to view these General Terms and Conditions. The order confirmation can be saved or printed using the appropriate function in your email.

4.3. Your order data is stored in our system. We offer each customer access to their customer account, protected by a password (click on "my account"). Once your customer account is created, you can find out about past, current, or recently shipped orders, manage and save your information (mailing address, telephone number, bank details), and subscribe to or unsubscribe from our newsletter. You agree to keep your customer account access data confidential and, in particular, not to disclose it to third parties.

4.4. We reserve the right to adapt or modify these General Terms and Conditions at any time and without prior notice. In this case, the adaptations or modifications will apply to all orders placed after the publication of the modified General Terms and Conditions on the website on which you make your purchase.

5. PRODUCTS - AVAILABILITY

5.1. The Products are all the goods offered for sale by ORÉ SRL on its website www.adorecosmetics.be

The Products offered by ORÉ SRL comply with current Belgian legislation and the standards applicable in Belgium.

ORÉ SRL will do its utmost to ensure that the photographic visuals accurately represent the Products offered for sale. Each Product is also accompanied by a precise description allowing its main characteristics to be known. Although we have made every effort to display the colors accurately, we cannot guarantee that the color display of a device accurately reflects the color of the products. In the event of a manifest error between the characteristics of the Product and its representation, the Member will have the right to return it and request a refund in accordance with Article 9 below.

5.2. Product offers are valid as long as they are visible on the site in question, within the limits of available stocks. In the event of unavailability of the product, or if an order cannot be executed due to circumstances beyond our control, we will inform you by email as soon as possible and will offer you either a product of equivalent quality and value, or the cancellation of your order. In the event of cancellation of the order, the sums you have already paid will be refunded to you within thirty (30) days following the cancellation of the order.

6. PRICE AND PAYMENT

6.1. The prices of our Products are mentioned in Euros, all taxes included, excluding participation in processing, customs and shipping costs, the amount of which will be invoiced in addition and will be indicated to you upon final validation of the order.

The tax applied corresponds to the Value Added Tax in force in Belgium, with the exception of orders placed by customers domiciled in France for which the tax applied corresponds to the Value Added Tax in force in France.

6.2. We reserve the right to change prices at any time, but the Products will in any event be invoiced on the basis of the rates in force at the time the order is placed.

6.3. The price displayed in your shopping cart is the sale price. Subject to applicable law, we are not responsible for, or required to honor, manifestly incorrect or erroneous prices.

If we accept and process your order where a pricing error is obvious and unmistakable and could reasonably have been recognised by you as a pricing error, we may (i) charge you the corrected price for the goods, or (ii) if you disagree with the corrected price, we may end the contract, refund any sums you have paid and require the return of any goods delivered to you.

6.4. At the end of the ordering process, the following payment methods may be offered to you to pay for your purchases on the e-commerce site www.adorecosmetics.be

- bank card (Visa, MasterCard, American Express),

- secure payment systems PayPal, Apple Pay

Regardless of the payment method you choose, any payment will only be considered final after the amounts have been effectively and fully collected by ORÉ SRL. We do not cover the costs associated with payments from countries outside Belgium.

7. CONCLUSION OF THE SALES CONTRACT

7.1. On the Site, contracts are concluded in French.

7.2. You can order products on our website by selecting them and placing them in your shopping cart. After selecting the desired Product(s) by clicking on the "ADD TO CART" icon, you will have the opportunity to confirm the composition of your cart, i.e. the specifics of the order, you will have the opportunity to check and modify it and confirm it by clicking on the "SECURE PAYMENT" icon, the order then becomes final. Please note that the products in your cart are not reserved for you until the ordering process is fully completed. You fill out an order form and must click on the "CHOOSE DELIVERY METHOD" icon. You will then be able to choose the delivery method, read the amount of the shipping costs and confirm your agreement by clicking on the "PROCEED TO PAYMENT" icon. The contract will be concluded when you click on the button allowing you to confirm your order after having viewed the details of it and in particular its total price and having had the opportunity to correct any errors. We will acknowledge receipt of your order by an order confirmation sent automatically by e-mail to the e-mail address you have provided.

7.3. Any placing of an order constitutes acceptance on your part of the prices and descriptions of the Products that you have placed in the basket.

8. DELIVERY

8.1. The Products ordered will be sent to the address you provided during the ordering process or to the collection point of your choice (depending on the carrier chosen). We are not responsible for delivery delays caused by you providing an incorrect or incomplete address.

8.2. We undertake to deliver the goods ordered on the website www.adorecosmetics.be as soon as possible after receipt of your payment.

8.3. We offer two delivery options: to your home or to a collection point via Mondial Relay or Bpost, depending on the shipping country. Delivery times vary depending on the shipping country.

For home delivery, if the recipient is absent when our transport provider arrives, the package will be left at a collection point near the delivery address. In this case, the customer can collect the package within 10 days upon presentation of an identity document and the delivery notice. After this period, unclaimed packages will be returned to us. We decline all responsibility for delivery delays caused by the absence of the recipient of the package or their failure to collect the package within the specified time frame.

8.5. When we are prevented from performing the contract by a case of force majeure or an unforeseeable event as defined by Belgian case law or by an external cause, in particular a fault attributable to you, the delivery period is automatically extended according to the duration of the impediment. We will inform you by email of the occurrence and end of such impediments. If the impediment lasts more than six (6) weeks, each party will have the right to terminate the contract automatically, without you being able to claim compensation from us.

8.6. In the event of non-receipt of the package, the customer may submit a complaint by email to contact@adorecosmetics.be within 4 weeks of the order date. After this period, the complaint can no longer be processed by the after-sales service. The customer agrees to respond to the responses received from the after-sales service within 2 weeks, otherwise the complaint can no longer be processed.

9. RIGHT OF WITHDRAWAL - RETURN

9.1. In accordance with Article VI.47 of the Code of Economic Law, our consumer customers have a period of fourteen (14) days from receipt of the goods to exercise their right of withdrawal without having to provide reasons or pay penalties. No right of withdrawal exists in particular for products made according to the Customer's specifications or clearly personalized or which, due to their nature, cannot be returned or are likely to deteriorate or expire quickly.

9.2. The withdrawal period is met if you inform us of the exercise of the right of withdrawal within fourteen (14) days.

This withdrawal must be made by sending us the model withdrawal form (form to download) or by sending us an unequivocal declaration indicating your choice to exercise your right of withdrawal within 14 days following the date of delivery of the products.

Notification of the exercise of the right of withdrawal can be sent to us by email at contact@adorecosmetics.be or by post, the postmark being proof of the date of the return request, to ORÉ SRL Avenue Victor Jacobs 8-10 1040 Etterbeek, Belgium

9.3. For any return of merchandise, please send the merchandise to the following address: ORÉ SRL Avenue Victor Jacobs 8-10 1040 Etterbeek, Belgium

You must return the Products to us within 14 days from the date of sending the Model Withdrawal Form or any other declaration.

9.4. The goods must be returned to us in perfect condition for resale, allowing them to be marketed as new and in their original packaging and blister pack, unopened and unused, failing which the refund cannot be made.

Any packages for which there is no information allowing the sender to be identified (surname, first name, address, order number) will also not be accepted.

9.5 Please note that all return shipping costs are the responsibility of the customer. Return shipping costs will not be refunded.

9.6. If you exercise your right of withdrawal within the aforementioned period, the price of the products will be fully refunded to you by bank transfer using the payment method used when ordering online.

The refund procedure is activated within forty-eight days after receipt of the returned products. The actual credit of the refund to your account or card will depend on the schedule of the credit institution or issuer.

10. LEGAL GUARANTEE AND CUSTOMER SERVICE

10.1. In the event of defects or non-conformity of the goods received, you benefit from the legal guarantees provided for by the legislation in force.

We will review your request as soon as possible and contact you after receiving the documents and/or your request or complaint. You can facilitate the processing of your complaint by describing the problem as accurately as possible, and by sending us a copy of the invoice or by providing us with the order references (order number, customer reference, etc.).

11. PROTECTION OF PERSONAL DATA AND COOKIES

12. APPLICABLE LAW, COMPETENT COURTS

12.1. The contractual relations between us and our consumer customers are exclusively subject to Belgian law and subject to the jurisdiction of the courts of the registered office of ORÉ SRL, subject to a specific attribution of jurisdiction arising from a particular law or regulation.

12.2. In the event of a dispute concerning the interpretation, execution or validity of these General Conditions of Sale, the Belgian courts shall have sole jurisdiction.

13. SEVERABILITY

If any provision of these T&Cs were or became void or unenforceable, the validity of the other provisions would not be affected. The void or unenforceable provision would then be replaced by the applicable legal provisions.
